Do you own or operate a restaurant or commercial food establishment in the greater New Orleans metropolitan area? What is a Grease Trap FOG Discharge Notice of Violation Letter?
Normally sent after your grease trap has been cleaned and/or inspected, this is a formal notification letter from the environmental department at the Sewerage and Water Board of New Orleans stating the contents within your grease trap (or grease interceptor) has exceeded 25% of the designed capacity for the combination of fats, oils, grease, and food solids.
Per grease trap FOG Ordinance 16.5, which is mandated and regulated by the S&WBNO, a restaurant and/or commercial food establishment must clean the grease trap at a minimum of every 90 days or at any time in which the grease trap reaches 25% FOG.
When does a Restaurant or Commercial Food Establishment Receive a Grease Trap Violation Letter from the Sewerage and Water Board of New Orleans?
As discussed above, you will receive a grease trap discharge violation letter at any time in which:
- The combination of fats, oils, grease, and food solids within the grease trap or grease interceptor exceeds 25%.
- The cleaning interval, or time between a grease trap cleaning service, exceeds a period of more than 90 days.
What Happens After a Restaurant or Commercial Food Establishment Receives a Grease Trap FOG Discharge Notice of Violation Letter? Are there any Associated Fines and/or Penalties?
Upon receiving a violation letter from the Sewerage and Water Board of New Orleans the restaurant or commercial food establishment in violation will be asked to clean the grease trap or grease interceptor in question. The S&WBNO will normally allow a 5 day grace period in which the grease trap must be cleaned and properly inspected by a permitted & certified grease trap cleaning company.
Depending on the severity of the situation, the Sewerage and Water Board of New Orleans has the authority to fine any restaurant or commercial food establishment in Orleans Parish that does not meet the obligations required by FOG Ordinance 16.5.
In certain situations in which a restaurant or commercial food establishment has neglected the cleaning of a grease trap to the extent that sewer main lines are obstructed by the illegal discharge of grease and other food related materials, the S&WBNO has the authority to charge all incurred costs of sewer main grease cleaning the guilty party.
